By making a purchase from our website, you agree to the following terms

1. You hereby waive and relinquish all claims of “product not described” or “unsatisfied with product” and you agree not to make any such claims with your credit card company. You certify you have fully understood everything about the products or services you are purchasing and have had the opportunity to ask any questions about such products or services.
2. In certain cases, the merchant processor may place a hold on the funds from your credit card transaction. In this case, we will inform you of the hold time. You will only receive the products or service once the funds have the hold removed and have been transferred to our bank. We do not control the period of holds, and they can be from a few days to a month or more. This is entirely dependent on the merchant processor. You waive all claims of liability against E Squared Travel for not the products or services a timely manner if the delay is due to a hold.
3. To comply with international regulations, you must provide your ID when making the purchase
4. Your credit card, billing address and ID will be validated. If any information does not match, we reserve the right to cancel your purchase.
5. You certify that the Shipping Address that you have provided is correct. You have verified it multiple times and confirm there are no mistakes. Once the products have been sent to that address, you waive relinquish any and all claims of “product not received” and agree not to make any such claims with your credit card company. Should you attempt to make such a claim, you agree that the record of the product being sent to the Shipping Address, respectively, is fully sufficient to confirm that you have received the product. Such proof will be provided by referencing the shipping transaction and you accept the third party shipper’s information as proof of the receipt of your purchase.
6. You agree to not use E Squared Travel Site, or any product or service which you purchase from E Squared Travel for any of the below
   • Unlawful Activity: Activity which would violate, or assist in violation of, any law, statute, ordinance, or regulation, sanctions programs administered in the countries where E Squared Travel conducts business, including but not limited to the U.S. Department of Treasury’s Office of Foreign Assets Control (“OFAC”), or which would involve proceeds of any unlawful activity; publish, distribute or disseminate any unlawful material or information.
   • Abusive Activity: Actions which impose an unreasonable or disproportionately large load on our infrastructure, or detrimentally interfere with, intercept, or expropriate any system, data, or information; transmit or upload any material to the E Squared Travel Site that contains viruses, trojan horses, worms, or any other harmful or deleterious programs; attempt to gain unauthorized access to the E Squared Travel Site, other E Squared Travel Customers, computer systems or networks connected to the E Squared Travel Site, through password mining or any other means; use E Squared Travel Account information of another party to access or use the E Squared Travel Site, except in the case of specific Merchants and/or applications which are specifically authorized by a user to access such user’s E Squared Travel Account and information; or transfer your account access or rights to your account to a third party, unless by operation of law or with the express permission of E Squared Travel
   • Abuse Other Users: Interfere with another individual’s or entity’s access to or use of any E Squared Travel’s Services or Products; defame, abuse, extort, harass, stalk, threaten or otherwise violate or infringe the legal rights (such as, but not limited to, rights of privacy, publicity and intellectual property) of others; incite, threaten, facilitate, promote, or encourage hate, racial intolerance, or violent acts against others; harvest or otherwise collect information from the E Squared Travel Site about others, including without limitation email addresses, without proper consent
   • Fraud: Activity which operates to defraud E Squared Travel, E Squared Travel users, or any other person; provide any false, inaccurate, or misleading information to E Squared Travel
   • Gambling: Lotteries; bidding fee auctions; sports forecasting or odds making; fantasy sports leagues with cash prizes; internet gaming; contests; sweepstakes; games of chance
   • Intellectual Property Infringement: Engage in transactions involving items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the law, including but not limited to sales, distribution, or access to counterfeit music, movies, software, or other licensed materials without the appropriate authorization from the rights holder; use of E Squared Travel intellectual property, name, or logo, including use of E Squared Travel trade or service marks, without express consent from E Squared Travel or in a manner that otherwise harms E Squared Travel or the E Squared Travel brand; any action that implies an untrue endorsement by or affiliation with
7. We reserve the right to cancel your order if we are aware of, or suspect that you may be using our products or services for any purpose above.
8. Refund Policy: There absolutely NO REFUNDS for any transaction in which the product has already been sent to the address specified or the service has been performed. Additionally, each product or service listing may have additional terms and limitations.
9. Error Policy: We are not responsible if you make an error in the typing of the Shipping Address. You must verify that you have entered the correct information on the order form, as well as the email confirmation you receive. If you find an error, you must contact us immediately. We cannot guarantee that we can cancel the transaction, but we will attempt to do so if the product has not already been sent. If your transaction is completed and the product sent before you contact us, there will be no refunds whatsoever.
10. Fraud Policy: We will monitor for fraudulent activity. Any attempted purchase of products or services with a credit card may be subject to additional verification, including but not limited to, a verification “selfie” image, proof of address, or any other such procedure that we may deem necessary to verify the legitimacy of the transaction and payment method. If we suspect fraud or you are unable to complete additional verification when requested, we reserve the right to cancel your transaction. Your IP address and other relevant information is logged, and any fraud attempts will be reported to authorities.
11. Your acceptance of these Terms of Use constitutes a legally binding agreement. You are signing this agreement by typing your name in the Signature Box of the order form.
12. You hereby waive any and all rights you may have against E Squared Travel or Square that you may otherwise have as a Visa, MasterCard or Amex Cardholder.
13. Should any of the provisions of this Terms of Use be deemed invalid, the remaining provisions shall remain in full force and effect
14. You consent to our storage of your data, under US Privacy and European GDPR laws, for the permissible business purpose of customer service and fraud prevention.
15. You consent that any dispute arising from these terms and conditions shall be resolved in arbitration, and waive any and all rights to resolve this matter in court
16. You agree that if for any reason, a credit card charge back is initiated by you and is successful, you will immediately owe the amount of the charge back to us. You also allow an attorney chosen by us to enter a confessed judgement in any court of the United States as determined by us for the full amount of the charge back, interest, and all attorneys fees to the maximum extend allowed by state law.
